Legal Notice concerning the website and social networks for Le Lothier – Hôpital Erasme

Hereinafter the “Institution”.

As a hospital structure, the competent surveillance authority for the Institution is the Federal Public Service (SPF) for Health, Food Chain Safety and the Environment. The activity of the Institution and of its employees is governed by various standards and codes of deontology, notably but not exclusively: 

Terms of use and disclaimer concerning the website and social network pages of the Institution

1. FIELD OF APPLICATION

These general terms of use (hereinafter the “GTU”) are addressed to and apply to all users and for any visit to and consultation of the content of this website (hereinafter “the website”) and pages of the Institution on social networks (hereinafter “the pages” and “the networks”).  

In using or consulting this website or the pages of the Institution on the networks, you acknowledge that you are familiar with and accept all the present provisions. 

The Institution reserves the right to change, in full or in part, the GTU at any time that it may deem  necessary and without prior notice. As a result, the user must consult theses GTU regularly so as to remain informed of any changes. The provisions in force at the time when you use or consult the website or social network page are the provisions that shall apply. 

2.  ACCESS TO AND USE OF THE WEBSITE AND SOCIAL NETWORK PAGES

The Institution shall take the necessary and reasonable measures to ensure that this website and its network pages remain operational, accessible and secure. However, no guarantee can be given and the Institution, bound to an obligation of means, cannot be held liable for any damage, direct or indirect and of whatsoever nature, that may result from using this website or a social network page, such as, by way of example and non-exhaustively, in the case of interrupted access, inaccessibility, malfunctioning, defective use or the presence of a virus.    

3. THE CONTENT OF THE WEBSITE AND SOCIAL NETWORK PAGES

The information present on this website and on the Institution’s social network pages is of a general nature and is not specifically intended for a particular situation.  It is possible that the content of this website and of the social network pages may not always be complete, correct, sufficiently precise or up to date. 

Although the Institution takes all necessary and reasonable measures to maintain the content of its website and network pages complete and sufficient, it cannot be held responsible or liable for any direct or indirect damage that the user may incur subsequent to consulting or using the said content. 

The Institution reserves the right to change and adapt this website and its network pages, including the layout, information and possibly the services that are proposed on them and this without prior notice being necessary  and without engaging its responsibility. 

If the content of the website and of the Institution’s pages on the social networks is found to contravene the law, ethics, morality or the rights of third parties, please inform us of this as quickly as possible via the address communication@hubruxelles.be  so that we can correct this as quickly as possible. 

Any downloading from the website or a social network page is always at the user’s risk. The Institution cannot be held responsible or liable for any damage, direct or indirect, of whatsoever nature that may be related to such downloading, unless a law rules otherwise. 

4. LInks to other websites

This website and the Institution’s pages on the networks contain links or hyperlinks that redirect to other websites or other pages on the networks. Other websites or pages can also contain links that redirect to the Institution’s website or pages.

The Institution has no relations and has no agreement, explicit or implicit, with these other websites or third party account or page owners on the social networks. It exercises no control of whatsoever nature over the said websites  or pages and  cannot be held responsible for their functioning, the quality of their content, the proper functioning of the links or the destination to which the user is directed on activating a link. 

On activating a link the user  leaves the Institution’s website or page. The destination website or page has its own policies and information documents (legal notices, disclaimer, private life policy, cookie policy)  and the Institution’s policies do not apply there. In the interests of security, the user is encouraged to consult the documents of the destination websites or pages. 

5. INTELLECTUAL PROPORTY

All the content of this website and of the Institution’s pages on the networks is the property of the Institution that owns the copyright. Content should be understood as including, among other things, photographs, articles or other texts, drawings, logos, soundtracks, films, videos and animations, etc.

Any use of the said content by any user is subject to express authorisation in writing from the Institution unless the consultation is for personal purposes, thus excluding for a commercial purpose, or for the purpose of teaching or research.      

The Institution recognises the application in full of legal exceptions to copyright as laid down in the  Code of Economic Law. When any of these exceptions applies, the user must nevertheless indicate the origin of any elements reproduced (that is, the possible title of the element reproduced, the author’s name if it is presented on the website, the name of the Institution, and the source website page address) and must respect the moral rights of the author(s) in question that the Institution wishes to have respected.  

The Institution authorises the creation of a hypertext link redirecting users to this website or to its network pages, provided that the initial website contains no defamatory remarks or any illegal content and that the creation of these links does not use any framing or inlining techniques.

6. OBLIGATIONS AND RESPONSIBILITIES OF THE USER

In addition to the other terms of use presented in this document, the user undertakes  to respect the following provisions: 

  1. The responsibilities referred to in this provision cover any act or omission by the user, voluntary or otherwise, in connection with the use of this website. 
  2. The user is responsible for the use the said user makes of this website and the Institution’s pages on the social networks. The user undertakes to use this website and the said pages in a manner that respects the GTU, the disclaimer, the law and in a reasonable manner, without negligence or ill intention. The user undertakes to refrain from any use for illegal purposes or contrary to good morals and from any act that could harm the rights, the image and the interests of the Institution, of its partners, of its suppliers, of its employees or of any other user. 
  3. The user is alone responsible for any data the user may choose to encode on the Institution’s website  and on its network pages, the Institution requesting the user to pay heed to security when making these choices.  The Institution ensures the security of users  by limiting the possibilities for the encoding and processing of data by putting into place organisational and technical measures. The Institution is responsible for informing the user  of any processing it carries out on encoded data and this information is available in the  Institution’s private life policies.
  4. It is forbidden for any user to enter data, on the website or on the pages, that could modify their content, lay out, appearance or proper functioning. 
  5. The user is responsible for the proper functioning of the devices it uses to use the said website and Institution’s network pages. The user is also responsible for any damage, direct or indirect, incurred by its computer system following use of the website or these pages, as well as for any loss of data resulting from the use or any downloading of any content from the website or any of the Institution’s pages. 

7. EXONERATION OF THE INSTITUTION’S RESPONSIBILITY

The exoneration of responsibility as described in these provisions covers all responsibility, contractual or otherwise, criminal or quasi-criminal, whether founded on  no-fault liability or otherwise, and this even when the Institution has been warned of possible direct or indirect consequences of using this website, the Institution’s pages on social networks or their respective content. 

8. IMAGE RIGHTS

Persons presented and who can be identified on this website or on the Institution’s social networks have authorised the Institution to use their image.

Any reproduction or other reuse of the image of a person presented on this website or the said pages is prohibited.    

9. PROCESSING OF PERSONAL DATA

The Institution shall respect Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and with regard to the free movement of such data   (“General data protection regulation, “Regulation” or “GDPR”).

10. APPLICABLE LAW AND JURISDICTION

Any use of this website and of the Institution’s pages on the social networks is governed by Belgian law. 

In the absence of an amicable agreement, any dispute concerning the use of this website or the said pages or their content falls under the exclusive competence of the Courts of Brussels.
